    Abstract: This paper contests the notion that the Actio Secunda of the speech In Verrem lacks a formal rhetorical structure. It has often been noted that Cicero’s earlier speeches generally conform to the precepts of speech structure (dispositio) and the alleged lack of formality of the Actio Secunda has been used to argue that this reflects its special status as a literary artefact, rather than a speech prepared for delivery in court. On the other hand, this paper suggests that the Actio Secunda does adhere to the precepts of speech structure when it is treated as one oration, rather than five separate speeches. By way of conclusion, it hopes to demonstrate that the Actio Secunda should be treated as an example of a real prosecution speech, whether or not any of it was actually delivered.
